The American crime drama Better Call Saul follows Jimmy McGill (also called Saul Goodman), a small-time lawyer with a very shaky moral compass. Despite the show’s excellent writing, Jimmy’s stock-in-trade [1] doesn’t reflect the reality (or banality) of being a lawyer. Unlike him, not many lawyers are associated with a Mexican cartel. What’s convincing about Jimmy’s character, though, is that he’s almost always a successful negotiator — a trait that is required of a strong lawyer.  Jimmy’s negotiations are always ongoing; he approaches every aspect of life as a form of negotiation, with calculations on grounds to gain, lose, or compromise. Moreover, when faced with confrontation directly or indirectly, he is neither too stubborn nor too pretentious. Instead, he looks the other party in the eye, and receives their invitation in a practical tone, responding with some version of: “Look... I know you’re upset. Here’s a solution.” In fact, some might describe Jimmy as opportunistic, bending over backward to gain and survive while pleasing other people. But the thinking of this character can tell us much about how we might ideally approach negotiation. People so often think of negotiation as a formal activity, but moments of negotiation can arise in our day-to-day lives. Planning a trip with friends for example is an unofficial multi-party negotiation. Picking a meal and choosing a home are all negotiations in one form or another in that each party brings to the table their sets of interests, desires, and expectations. The goal is to find a solution that leaves the parties satisfied. So instead of strictly separating the way you think about formal contracts and your personal relationships, consider where those situations dovetail [2]. Another takeaway is that thinking outside the box can lead to better outcomes in negotiations. Jimmy conceives these creative solutions that can satisfy all the parties involved -- and thus will maximize the overall utility. Underlying his creative approach is the idea that negotiation doesn’t have to be a zero-sum game. The language he uses when engaging in negotiation reflects this perception. Jimmy uses the language of cooperation in de-escalating conflicts by solacing the other party into listening to reason. His trademark approach seems to be, “I see your frustration, but from a practical standpoint...” -- in other words, he is keen to work together towards a common goal by bridging emotional gulfs.  In fact, his approach is in line with the essence of negotiation, which is by definition a discussion aimed at reaching an agreement. Finding ingenious solutions to satisfy all parties involved is the crux of good negotiation. If you happen to have an opportunity to watch Better Call Saul, consider carefully observing Jimmy’s negotiating methods. Who knows? A TV show might allow you to negotiate an excellent deal in your professional capacity.
