2021년 2월 호주 정부는 “뉴스 미디어 협상 규정”이라는 새로운 법을 통과시켰습니다. 이 법은 페이스북이나 구글과 같은 거대 테크 회사들이 뉴스 컨텐츠를 사용할 때 뉴스미디어 회사에 사용료를 지불하라는 것입니다. 이 법이 어떤 영향을 미치고 있는지 이야기를 나눠보세요.

In February 2021, Australia passed a new law — the News Media Bargaining Code, setting a major precedent for other countries to follow suit [1] in the future. With this new law, tech giants, including Facebook and Google, would have to pay local news outlets to link their content in news feeds and search results.  Payment deals that are yet to come will specify the amount tech companies should pay Australian news publishers, and while an independent arbitrator can manage these negotiations, the overall result might benefit the news organizations regardless. Additionally, the law requires tech companies to announce any changes to their algorithms which determine what news stories are displayed to readers. Previously, news publishers had little negotiating power against these tech giants because they were so reliant on them. As social media becomes a regular part of the general public’s lives, many individuals now frequent Facebook, Instagram, Google, and even Snapchat just to stay updated on the news. Oftentimes, social media is the first place that people hear about major news. As a result, it was no surprise that the new law immediately faced immense backlash from [2] tech companies. Facebook even went to the extreme measure of blocking all of their news content to Australia. Google and Facebook both argued that lawmakers failed to understand how the internet truly works. They argued that they already contributed to news publishers by providing another avenue for [3] readers to access the publishers’ news sites. They help readers “find news content” rather than take readers away from them. Furthermore, after negotiating and lobbying with the government to change aspects of the law, Facebook eventually agreed to restore news pages back on its platform in Australia. Interestingly enough, Facebook wanted to add a caveat to the law — “prior to applying the law to a company, the government must consider the platform’s previous commercial contributions to the news platform.”  For readers, a major question is how this legislation will influence news consumption for the public. Facebook and Google might decide not to share certain news content because of the cost. That said, these companies would have to decide what news content they are willing to pay for, which indirectly influences the type of content the public consumes. On the other hand, critics will argue that these social media platforms already filter the types of content that users read through their algorithms. This law would only increase transparency and fairly pay news publishers for their efforts.  This decision has also already begun to influence other governments across the world. Similar laws might soon emerge in other countries, including the US, Canada, and the UK. In fact, Canada’s government has already said that it plans to introduce a similar law in the near future.

2021년 2월 호주 정부는 “뉴스 미디어 협상 규정”이라는 새로운 법을 통과 시키며 다른 나라들도 향후 유사한 조치를 취하게 될 선례를 남겼습니다. 이 법에 따라 페이스북이나 구글과 같은 거대 테크 회사들은 뉴스 컨텐츠를 피드나 검색 결과에 보여줄 때 뉴스미디어 회사에 사용료를 지불해야할 것입니다. 테크 회사들과 언론사 간 협상에 따라 지불 조건이 정해질 것이고, 독립적인 중재자가 이들 중간에서 협상을 중재할 수도 있겠는데, 어쨌던 언론사에게 더 유리하게 작용할 가능성이 높습니다. 이에 더해, 새 법은 테크 회사들이 어떤 뉴스를 독자들에게 보여줄 것인가를 결정하는 데 쓰는 알고리듬을 변경할 경우 반드시 그 변경 내용을 공표하도록 의무화하고 있습니다.      	이제까지 뉴스 기관들은 테크 회사들에 대한 의존도가 매우 높았기 때문에 이러한 거대 테크 회사들과 협상을 시도할 입장이 아니었습니다. 소셜미디어가 일반인들의 생활에 깊숙히 자리잡으면서 현재 많은 사람들이 뉴스를 실시간으로 업데이트 받기 위해 페이스북, 인스타그램, 구글, 심지어 스냅챗을 찾습니다. 사람들이 주요 뉴스를 처음 접하는 곳이 언론사이 아닌 소셜미디어인 경우도 흔해졌습니다.    그렇기 때문에 이 새 법규가 즉각적으로 테크 회사들의 심한 반발을 불러일으킨 것은 전혀 놀랄 일이 아닙니다. 페이스북은 심지어 호주내 페이스북 사용자들에게 뉴스 피드를 전면봉쇄하는 극단적인 조치를 취하기도 했습니다. 구글과 페이스북은 입법자들이 인터넷이 실제로 어떻게 돌아가는지를 전혀 이해하지 못하고 있다고 주장합니다. 이들은 자기들이 독자들을 뉴스 기관의 사이트로 연결해주는 또다른 통로 역할을 함으로써 뉴스 회사에 공헌하고 있다고 주장합니다. 독자들을 뉴스 회사로부터 빼앗아오는 것이 아니라 “뉴스 컨텐츠를 찾도록” 도와준다는 겁니다. 새 법의 일부를 수정하려고 호주 정부와 협상과 로비를 벌인 후에야, 페이스북은 호주 사용자들이 뉴스 페이지를 볼 수 있게 열어주는데 합의했습니다. 재미있게도 페이스북이 이 법에 새로운 조건 하나를 추가하기를 원했습니다. 그 조건은 “이 법을 테크 회사에 적용하기에 앞서, 정부는 테크 회사들이 뉴스 기관에 대해 이제까지 기여한 상업적 공헌을 고려해야 한다”는 것입니다.               독자로서 가질 만한 주요한 의문은 이 법이 일반 대중의 뉴스 소비에 어떤 영향을 미칠 것인가 하는 것입니다. 페이스북과 구글이 비용을 아끼기 위해 어떤 뉴스 콘텐츠는 제공하지 않겠다고 결정할 우려가 있습니다. 즉, 테크 회사들은 어떤 뉴스 컨텐츠가 돈을 지불하고 사용할 만한지 결정하게 될 것이고, 이것은 간접적으로 대중이 어떤 정보를 소비 하는데 영향을 미칠 것입니다. 반면에 테크 회사들에 대해 비판적인 사람들은 이미 소셜미디어 플랫폼들이 이미 자기들의 알고리듬을 통해 독자들이 볼 수 있는 컨텐츠 내용을 거르고 제한해 왔다고 말합니다. 따라서 이 법은 단지 그 선택 과정의 투명도를 높이고 뉴스 기관이 자기들의 뉴스에 대한 정당한 대가를 받도록 해주는 것일 뿐이라고 합니다.      호주의 결정은 이미 세계 다른 나라 정부에도 영향을 미치기 시작했습니다. 미국, 캐나다, 영국을 포함 다른 나라에도 이와 비슷한 법이 곧 등장할 수 있습니다. 실제로 캐나다 정부는 빠른 시일 내로 이와 유사한 법을 도입할 계획이라고 발표했습니다.
