In the dusty attic of my brain are a collection of childhood memories of dictionaries, case books, and novels covering the floor and stacking up on an oak desk as my father hunkered over his reading assignment. This man, then a law student who would later become a corporate transactional lawyer, didn't have much time to spend with his daughter. I would imitate what he was doing by scribbling down indecipherable [1] things on paper. Fast forward a little less than two decades, and this little girl is admitted to her dream law school on the East Coast.  Perhaps the idea of following in the footsteps of my father has anchored and shaped the way I think about my future. And more than what I’d like to admit, my decision to go to law school has been affected by what Daniel Kahneman would call “lazy” thinking–the type of thinking that doesn’t involve much scrutiny. Nevertheless, I tried my best every step of the way, and here I am armed with a better understanding of the process than when I had started.  The advice that everyone considering going to law school gets is to think about why they want to practice law. And if you cannot articulate a convincing answer, they say, “Please don’t go to law school. It’s just not worth it.” Although well-intentioned, this type of advice can be counterproductive. A better question may be: “Which practice areas and places of employment would you be interested in, and why?” This line of inquiry provides a framework for understanding the crude “why law” question. I’ve come to narrow down my goals to becoming a litigator handling antitrust and securities cases in a firm with a relatively high partner to associate ratio. Your interests may change with time, but pivoting is better than drifting aimlessly through admissions and beyond.  That said, it is important to set realistic expectations. People often pursue a law degree thinking that prestige and money are guaranteed; like any job, the legal profession is no bed of roses. Jeffrey Chapman, Co-Chair at Gibson, Dunn & Crutcher (LLP), once said in an interview:  “There was … a long period of time in my career when I wasn’t sure I wanted to continue to practice law, and I didn’t necessarily enjoy it as much as I do now. I can safely say I love practicing law now more than I ever have. When I was 40 years old, I came within a hair’s breadth away from [2] going to Bear Stearns and becoming an investment banker. I’m glad I didn’t, but it was a very close call at the time.”  Ultimately, going to law school is a personal decision, and there is no simple formula for calculating your fit for the legal profession. But if you do your research and make an informed decision, you will make headway no matter what direction you take.

아버지는 머리를 파묻은 채 수업 과제물을 읽고 계시고 각종 사전, 판례집, 소설책들이 바닥에 흩어져 있고 참나무 책상 위에 쌓여 있던 광경은 제 어린시절에 대한 오랜 기억 한켠에 자리잡고 있습니다. 훗날 기업거래 변호사가 된 아버지는 당시 로스쿨 학생이었기 때문에 딸과 함께 놀 시간이 별로 없었습니다. 저는 종이에 뭔지 모를 것들을 갈겨쓰면서 아버지가 하던 것을 흉내내곤 했습니다. 시간은 흘러 그로부터 20년이 채 지나지 않은 지금 그 어린 소녀는 꿈에 그리던 미국 동부의 한 로스쿨에 합격합니다.  어쩌면 아버지의 발자취를 따라가고자 하는 생각이 제가 미래를 설계하는 데 있어서 중심에 자리잡고 영향을 미쳤는지도 모릅니다. 그리고 제가 인정하고 싶은 정도를 넘어서, 로스쿨에 가겠다는 제 결정은 대니얼 케인먼이 “게으른” 사고방식이라고 부를 법한, 심사숙고하지 않는 사고방식 때문이었습니다. 그렇지만 저는 매순간 최선을 다했고 이젠 처음 시작했을 때보다 그 과정을 더 잘 이해한다고 자부합니다.  로스쿨에 갈까 고려하는 모든 사람들이 듣는 조언은 왜 법조계에서 일하고 싶은지를 생각해보라는 것입니다. 그리고 이 질문에 대한 설득력 있는 대답을 조리있게 하지 못한다면 “그럴만한 가치가 없으니 로스쿨에 가지 말라”고 말합니다. 이러한 조언은 그 의도는 좋을지 모르나 역효과를 낳을 수 있습니다. 아마 이렇게 묻는 것이 더 좋을겁니다. “어떤 분야의 법을 하고 싶고 어떤 곳에서 일하는 데 관심이 있으며 그 이유는 무엇입니까?” 이런 식의 질문은 “왜 법이냐”라는 거친 질문을 이해할 수 있는 틀을 제공합니다. 저는 반독점이나 증권 관련 사안들을 다루는 소송 변호사가 되어 변호사 대비 파트너의 비율이 높은 회사에서 일하는 것으로 목표를 좁힐 수 있었습니다. 여러분의 관심사는 시간에 따라 달라질 수는 있으나, 방향을 전환하는 것이 지원과정과 그 이후까지 목적없이 헤매는 것보다 낫습니다.  그렇긴 하지만 현실적인 기대치를 가지는 것이 중요합니다. 사람들은 종종 특권이나 수입이 보장되어 있다고 생각하며 로스쿨에 가고자 합니다만, 여느 직업과 마찬가지로 법조인이라는 직업이 편하고 화려한 것만은 아닙니다. 깁슨, 던 & 크러처(LLP)라는 법률회사의 공동 대표인 제프리 챕먼은 어느 인터뷰에서 이렇게 말했습니다.  “내 커리어에 있어서 꽤 오랫동안 내가 법을 계속하고 싶은지에 대한 확신이 없었던 때가 있었고 지금처럼 이 일을 즐겼던 것도 아니었습니다. 단언컨대 지금은 그 어느 때보다 내가 하는 일을 사랑한다고 말할 수 있습니다. 40살때 나는 베어스턴즈로 가서 투자은행가가 되려고 거의 결정했습니다. 그러지 않았다는게 다행이지만 그 당시에는 정말 거의 그럴 뻔했습니다.” 결국 로스쿨에 가는 것은 개인적인 결정이고 법조인이 자기 적성에 잘 맞는지 계산해볼 수 있는 간단한 공식은 없습니다. 그러나 충분히 조사를 해보고 정보를 수집한 후 결정을 내린다면 어느 길을 택하든지 앞으로 나아갈 수 있을 것입니다.
