Following Britain’s humiliating defeat during the American War of Independence, the newborn United States faced a challenging task: constructing a well-functioning, competent government. They wanted to avoid the centralized tyranny of King George III, from whom they had just parted, yet maintain among the states a strong relationship with a central government. After a summer of deliberation, the Founding Fathers landed on a solution: federalism. Federalism is less a type of government, like democracy or oligarchy [1], and more an organization of a political system. In the US, federalism empowers [2] states to make their own democracies—to act as “laboratories of democracy,” in the words of late Supreme Court Justice Louis Brandeis. However, states still maintain an intimate relationship with the federal government, and through that partnership, each level of government (local, state, and federal) expresses varying degrees of political independence and authority.  For instance, the No Child Left Behind Act of 2001 carved a new role for the federal government in public education, as its provision of federal funding to the states was contingent [3] on the academic achievement of each state’s students. The philosophy behind the Act was that setting high, measurable academic standards in K-12 schools would improve the academic performance of individual students, hence the name of the Act. However, it was up to the states to set and reach those measures, and successfully reaching those standards was rewarded with federal funding.  The No Child Left Behind Act is an example of cooperative federalism, wherein the federal government writes laws that the states execute. This is also known as marble cake federalism, since the responsibilities of each level of government flow together, like a marble cake. There are several other forms of federalism as well, such as dual federalism, which comes with another dessert-related nickname, layer-cake federalism. In this organization, the responsibilities of the states and federal government are clearly defined, and the states act without interference from the federal government.   Federalism balances many interests, such as the agency [4] of lower levels of government and the federal government’s desire to maintain a watchful eye. Sometimes, the lines between their spheres of power are blurred, and each level of government is left skirting responsibility, pointing fingers at the other levels. This image sometimes materializes during natural disasters, like when Hurricane Katrina leveled New Orleans, Louisiana, and it was unclear who should shoulder the bulk of the relief efforts—the city, state, or nation.  Federalism is, always has been and always will be, a work in progress. It was the product of compromise between the original 13 states and is consistently rewritten by the current states and territories. It is, however, the backbone of American democracy that secures some level of autonomy for local, state, and the federal government, allowing each level to govern itself and keep others in check.

(레이어 케이크는 사이사이에 필링을 넣어 여러 층으로 쌓아 만든 케이크입니다) 이 형태에서는 각 주와 연방정부의 책임들이 따로 명확하게 규정되어 있어 각 주정부는 연방 정부의 간섭 없이 독자적으로 움직입니다. 연방주의는 많은 이해관계 사이에서 균형을 유지합니다. 하위 정부의 관청과 감시역을 하고자 하는 연방정부 사이의 균형 등이 그예입니다. 때로는 권한의 경계가 불분명해서 각 단계의 정부가 책임을 회피한 채 서로 다른 정부를 비난하기도 합니다. 이런 모습은 허리케인 카트리나가 루이지애나주의 뉴올리언스를 휩쓸었을 때처럼 자연재해가 발생했을 때 구체적으로 드러나는데 당시 엄청난 구호활동의 책임을 시와 주, 국가 중 어느 정부가 짊어져야 하는지 명확하지 않았습니다. 연방주의는 이제까지 그랬듯이 앞으로도 완성을 향해 계속 진행중인 과제가 될 것입니다. 이것은 건국 초기 13개 주들이 서로 타협한 결과물이었고 현재도 각 주의 정부와 미국령의 정부들이 계속 새로운 형태로 만들어가고 있습니다. 그러나 이것은 각각의 정부에게 자율적인 통치를 허용하고 서로 견제하도록 하면서 지방정부, 주정부 그리고 연방정부에 대한 어느 정도의 자치권을 보장하는 미국 민주주의의 근간입니다.
