The Founding Fathers of the United States did a tremendous job establishing a country with a Constitution that is both the “supreme Law of the Land” and enduring—it is essentially the oldest working constitution in the world (depending on how you define constitution). But that is not to say that the Founders were entirely clairvoyant [1]; the interpretation of the Constitution and American democracy have fundamentally changed since 1778, when the Constitution was officially ratified [2].  It took only 15 years for the Constitution’s legitimacy to be seriously challenged. In Marbury v. Madison (1803), the Supreme Court had to decide whether it had the constitutional authority to strike down laws that contradict what is enumerated [3] in the document. In a petty political conflict between John Adams and Thomas Jefferson, the second and third Presidents of the United States, Jefferson told his Secretary of State, James Madison, to not confirm some of Adams’ judicial appointments before Adams left office. One of those appointments, William Marbury, sued Madison, and the case made its way to the Supreme Court. In their ruling, the Court found that Madison had acted illegally when he did not deliver Marbury’s confirmation, and in doing so, confirmed that they had the power to adjudicate [4] in such a manner.  Considered the most important case in the history of the Supreme Court, Marbury v. Madison established the power of the Court, thereby confirming the legitimacy of the Constitution and defining further the powers of the three branches of government. This was not the last time, however, that the Constitution required confirmation, or that its inadequacies came to light. Indeed, the Constitution originally did not allow citizens to vote for their Senators; instead, state legislatures elected Senators. This lasted until 1913, when the 17th Amendment established the direct election of Senators. The Constitution was similarly changed with the 15th and 19th Amendments, which prohibited the disenfranchisement [5] of voters based on their “race, color, or previous condition of servitude,” or sex, respectively.  In the name of democracy, the Constitution has been amended and reread countless times. Whether to confer or withhold political power, or to bolster democracy in critical ways, the Constitution’s deficiencies have not been ignored. Rather, if there is a single issue that requires the United States’ utmost attention and dedication, it may very well be the Constitution. Without clear rules and guidelines, not to mention a strong protection of individual rights and liberties, the Constitution would be little more than an unclear, poorly written collection of ideals and principles, rather than a strong governing document. Debate abounds over whether the Constitution should be read as it is written, meaning that its clauses should be interpreted and applied as its original authors understood their own words, or is a living document, one whose words are redefined as social, political, and cultural conditions change. The various ways of constitutional interpretation have potent strengths and weaknesses, and no matter which side of the debate that you fall on, one thing is for certain: the Constitution is not impervious [6]. Its words are not always clear, and often need to be evaluated by the courts, or do not sufficiently serve democracy, and so require amending.
